Conditions of sale


Item 1 - Scope of application

This agreement, concerning general sales, applies to all on-line purchases made on the internet site www.clarinet-edition.fr between the CLARINET EDITION Association, siège social : 38 Quai de Polangis, 94340 JOINVILLE LE PONT, FRANCE.

These conditions set out to define the terms of sale between CLARINET EDITION and any physical or legal person, hereinafter called "the customer", wishing to make a purchase via CLARINET EDITION’s Web site www.clarinet-edition.fr.

When placing an order, the customer acknowledges having made himself aware of the general sales conditions on display on www.clarinet-edition.fr.

These general sales conditions can be modified at any time by CLARINET EDITION provided they appear on the Web site www.clarinet-edition.fr. These terms concern exclusively the individuals or legal entities who are not members of the trade who purchase the products available on the aforementioned site, for their personal use, to the exclusion of any trade or resale.

These terms of sale will remain in force throughout the duration of the period of their display on-line, but may be amended at any time at CLARINET EDITION’s initiative.

The amendment will be effective only for sales placed after the date on which the amendment has been placed on-line, unless this placing on-line is the result of an obligation under an imperative law, immediately applicable on French territory.

Item 2 - Orders

CLARINET EDITION reserves the right to cancel any order made by a client with whom there exists a legal dispute concerning the payment of a previous order.

When you click on the Validate button at the end the ordering procedure, you declare to have fully accepted, without reserve, all of the general sales conditions.

The data recorded by The CLARINET EDITION Association serves as proof of all of the transactions between CLARINET EDITION and the client. For on-line payment, the data recorded by the payment system, CYBERMUT (C.I.C. – Crédit Mutuel), serves as proof of all financial transactions.

The indicated price does not include delivery charges. Invoices are issued in the currency chosen for payment.

For each order, a corresponding invoice is sent by e-mail to the orderer and a delivery note is adjoined to the delivery packet. The invoice lists the order lines item by item and shows the delivery charges. All orders paid for on-line will be confirmed by e-mail at the address provided by the client. The information supplied by the customer at the time of ordering is a commitment by the customer. In the event of any errors made by the customer in entering the address and contact details of the recipient of the order, CLARINET EDITION can not be held responsible for any resulting inability to deliver the goods.


Item 3 - Price conditions

All prices are expressed in euros (€) or in the currency chosen by the customer at the moment of placing the order, excluding the contribution to the costs of processing and shipment. Music scores (ou sheet music, mais je préfère le premier) or CD that are offered by the CLARINET EDITION association are VAT free as a decision made by the French tax office of Créteil FRANCE.

CLARINET EDITION reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the order is registered. Duties or other local taxes, import fees, or state taxes may be payable depending on the geographic zone that you have chosen. These charges and fees are not the responsibility of CLARINET EDITION. All declarations and payments to the corresponding authorities and organisations are the purchaser's full responsibility. We advise you ask for information about these issues from your local authorities.

Item 4 - Shipping costs

Orders placed on the www.clarinet-edition.fr site entail shipping charges. They are calculated according to product weight, country of destination, and the rate chosen.

These charges are indicated in the order summary upon validation.

Customs duties or other local taxes or import duties or state taxes may be payable depending on the geographical area chosen by you. These rights and sums do not fall within the jurisdiction of CLARINET EDITION. They will be your responsibility and are your sole responsibility both in terms of declarations and payments to the competent authorities and/organizations in your country. We advise you to inquire about these aspects with your local authorities.


The client acknowledges being fully informed about the shipping and handling costs that are in addition to the price of the ordered articles

Item 5 - Payment

CLARINET EDITION's Association reserves the right to block the processing of any account and all deliveries in the case of refused credit card payment authorisation by the officially accredited organisms, or in the case of non-payment. The price is immediately due for payment on the order date.

Purchases can be paid for in the following ways :

1) By credit card on line.

When ordering, you must indicate your credit card number (16 numbers) and its expiration date, directly in the appropriate space (secured by SSL encryption and sent via our secured credit card payment system to the C.I.C. Cybermut, Crédit Mutuel, which will alone receive the banking information being sent).

2) By cheque made out in euros, acceptable by a French bank.

The cheque must be made out to Association Clarinet Edition, accompanied by the printed order form, and sent to the following address :

Item 6 - Delivery

Products are delivered to the delivery address indicated by the Consumer during the ordering process.

In the event of payment by banking card, the delivery process is triggered immediately and in all events within a maximum period of 30 days following receipt thereof.
In the event of payment by check, the order will not be processed until the check is cashed.


All products sold are checked on the date of their shipment and leave in good condition. The Consumer shall inform the deliveryman of any trace of damage on the package and, as the case may be, immediately unpack it before signing. In the event of a problem, the Consumer must mention the defect in writing and refuse the package as the case may be. A new identical product will then be sent to the Consumer at no expense.


Any anomaly concerning delivery (damage, products missing compared to those listed on delivery voucher, damaged packaging…) must be indicated on the delivery voucher in the form of “handwritten reserves” accompanied by the client’s signature. The Consumer must confirm this anomaly immediately afterwards in a letter to CLARINET EDITION.

Products declared as damaged during transportation shall be exchanged at no cost only if a reserve has been expressed at the time of the acceptance of the package and mentioned on the transportation voucher.

Item 7 - Satisfaction or refund

Up to 10 days after the date of shipment of the goods by CLARINET EDITION (a postmark acting as proof) you have the right to return them.

The good must be returned in their original wrapping in order to obtain a refund or exchange them for other items of the same value.

Prior agreement is nonetheless required from CLARINET EDITION before the return takes place.
If the item is returned because you are not satisfied with it, the ordered goods value is refunded but the delivery costs remain at your charge. If the item is returned due to a fault of CLARINET EDITION, the ordered goods value and the delivery costs are refunded.
To process your return, we request customers to make sure they state their first and last name, address, order date and number, and user name (log in).

A refund cheque will be sent to you no later than 20 days after receipt of the return.

Items that are returned incomplete, damaged, or soiled by the customer will not be taken back.

Item 8 - Intellectuel property

All the texts, commentaries, works, illustrations and pictures reproduced on the www.clarinet-edition.fr website are reserved with regard to copyright for the entire world. In accordance with the Code de la Propriété Intellectuelle, any use unauthorized by Clarinet Edition will be liable to prosecution.

All music scores offered on the website are registered and protected. All rights reserver for the entire world.

Any partial or total reproduction of the Clarinet Edition catalogue is strictly forbidden.

Item 9 - Disputes

The contract concluded by the customer at the order validation is submitted to the French law.

The language describing the contract by the present terms of sale is the French language. In case of a dispute, the courts of Paris only will be competent.

Item 10 - Confidentiality

The personal data given by the customer or collected while browsing through the website is meant to carry out a proper delivery and improve the quality of the service proposed to the customer.

Unless otherwise specified, the customer allows Clarinet Edition to use this data in order to regularly send him information regarding the development of the services proposed by the Clarinet Edition website.

This data will in no way be given to other companies than those designed by the term Clarinet Edition.


In accordance with the Loi Informatique et Libertés of January 6 1978, the customer has access to his personal data file and may correct it.

The customer is informed that the automatic data processing has been subject to notification at the Commission Nationale de l'Informatique et des Libertés (CNIL) under number : 1230659
